1. Acceptance of These Terms
These Terms of Service ("Terms") govern your use of the website at voltpouches.com, the VOLT waitlist, the referral program, and any related services (collectively, the "Service") provided by VOLT Performance Co. ("VOLT," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Legal Capacity
You must be at least 18 years old and able to form a legally binding contract under the law of your jurisdiction to use the Service. This is the standard contract-capacity baseline that applies to any online sign-up or purchase. It is not a product age restriction — VOLT products are nicotine-free, sugar-free performance pouches.
3. Description of Service
VOLT is preparing to launch a line of performance pouches. The Service currently allows you to:
- Join the Batch 001 waitlist by providing your email, phone, name, and optional product preference.
- Receive a numbered Founder Pass that records your signup-order position.
- Receive a personalized referral link in the format
voltpouches.com/pass/<your-handle>. - Earn tier-based rewards by sharing your referral link (see Official Referral Program Rules for details).
- View a personalized dashboard at
/dashboard/<your-id>showing your Founder number, tier, referral count, and rank.
4. User Conduct
When using the Service, you agree NOT to:
- Submit false or misleading information (including fake email addresses or phone numbers).
- Impersonate another person or entity.
- Create multiple accounts to inflate your referral count, or otherwise manipulate the referral program.
- Use automated tools (bots, scrapers, scripts, click-farms) to interact with the Service.
- Pay or otherwise compensate third parties for referrals in a manner that violates applicable advertising or consumer-protection law.
- Attempt to access, modify, or disrupt the Service's infrastructure or data.
- Use the Service to harass, threaten, or defraud any person.
- Violate any applicable local, state, federal, or international law.
Violations may result in immediate suspension or termination of your account and disqualification from the referral program, without notice and without refund or compensation.
5. Referral Program
The VOLT referral program is governed by separate Official Referral Program Rules, which form part of these Terms by reference. Highlights:
- Tier thresholds at 3, 10, 25, and 50 verified referrals (Bronze through Diamond).
- Top 100 referrers receive the Full Founder Kit and VOLT LEGEND status.
- The #1 referrer at program end wins "Free VOLT for Life" (defined in the Rules).
- A referral is verified only when the referee completes step 2 of waitlist signup (provides phone number).
- Self-referrals, fraudulent referrals, and incentivized clicks are void.
6. Intellectual Property
The Service, including the VOLT name, logo, brand identity, copy, design, and software, is owned by VOLT Performance Co. and protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any VOLT content without our prior written permission, except for personal, non-commercial use of your own referral link.
You retain ownership of any content you submit (such as your name or email). By submitting, you grant VOLT a worldwide, royalty-free license to use that content for the purposes of operating the Service.
7. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, either express or implied. VOLT does not warrant that the Service will be uninterrupted, error-free, or secure.
Product launch dates are estimates and may change. Joining the waitlist does not guarantee you a product, a price, or a specific delivery date. Batch 001 quantities are limited.
Statements regarding VOLT products have not been evaluated by the Food and Drug Administration. VOLT products are not intended to diagnose, treat, cure, or prevent any disease. Consult a physician before use if pregnant, nursing, taking medication, or managing a medical condition.
8. Limitation of Liability
To the maximum extent permitted by law, VOLT and its officers, directors, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.
VOLT's total liability for all claims arising out of or relating to the Service shall not exceed the greater of $100 USD or the amount you paid VOLT in the 12 months preceding the claim (which, for pre-launch waitlist users, is $0).
9. Indemnification
You agree to indemnify and hold VOLT harmless from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any rights of a third party.
10. Termination
We may suspend or terminate your access to the Service at any time, for any reason, without notice. If we do, your referral progress may be forfeit. You may stop using the Service at any time by emailing us a deletion request (see Privacy Policy).
11. Governing Law
These Terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-laws principles.
12. Dispute Resolution
Before filing any formal dispute, you agree to first attempt to resolve the issue informally by emailing crew@voltpouches.com with a description of your concern. We will respond within 30 days.
If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Jackson County, Missouri. You and VOLT consent to the personal jurisdiction and venue of those courts.
Arbitration opt-out: If VOLT later adds a binding-arbitration clause to these Terms, you will have 30 days from the date of that change to opt out by emailing crew@voltpouches.com with the subject line "Arbitration Opt-Out." Today, no binding arbitration applies.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date. For material changes, we will notify waitlist members by email at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
